If he had bombed the building at 4 am, he'd be a political prisoner. Since he
bombed it at a time he knew there would be innocent civilians (and little
kids in the daycare), and he was well trained in the laws of war, he is
instead a war criminal. Whether it was his idea to bomb at that time, or if
the idea was planted by the mysterious John Doe #2, it was still his decision
to do so at that time. Now, WHAT he is being executed for at this time is NOT
the deaths of any of the civilians, but only for the deaths of the 9 federal
agents killed in the blast. Of all the victims, their deaths were the most
justified, so on that basis you are correct, however this leaves the lives of
the civilians killed unredressed.
