Tobacco is grandfathered in because it predated the laws. This is why there
is so much controversy over the whether the tobacco companies genetically
engineered a new strain of tobacco or whether they modify the nicotine
levels in the product. If they did, it would count as a new product with
different characteristics, and would be subject to current laws.
