If there is actual peer reviewed, double blind studies that show an effect beyond
that of placebo, then that is admissible in court. If the acupuncturists are
making claims that are in excess of the effects determined in scientific studies,
that is STILL fraud, even if there is evidence of some effect. Exaggerated claims
on a real effect are as fraudulent as any claim on no effect, especially when the
exaggerator KNOWS that he is exaggerating.
