Profit is not the determining factor anymore. That used to be the case, but
the RIAA had that "profit" loop-hole closed with the enactment of the NET
Act. Now, regardless of whether you are doing it for profit, if you copy a
copyrighted work without permission from the copyright holder, you are a
criminal.
