Hmm, it says:

"adding to the
 whole Number of free Persons, including those bound to Service for a
 Term of Years, and excluding Indians not taxed, three fifths of all
 other Persons."

so to me that's not clear at all; it could be read either way, but mine
seems the more obvious reading. I guess we'd have to see how it was
applied at the time to find the correct answer.
