Terry,

This was extremely interesting to me, on a personal level. In 1997 I had a
similar accident. A truck made a left turn directly in front of me and I
laid the bike down to prevent being permanently affixed to his side door.
Anyway as I was laying on the ground an old man came up and told the EMT's
that he saw the entire thing and the truck driver was at fault. The driver,
nor his pax. ever got out of the vehicle and to this day I have not seen
their faces nor spoken with them. Later in the hospital the PD came and ask
for my story. When I told them they advised me that is wasn't the way the
driver or the witness saw it. I was at fault, since I last control going
over a hill in the road (?). Turns out the driver's witness was his pax.
When I ask Mr. Cop if he had spoken with my witness, the man who lived on
the corner he said no, and this was clearly a problem for the insurance
companies to work out. Problem: Turns out that the truck guy didn't have
any insurance. I ended up suing my own insurance company under the
Uninsured Motorist Clause and collecting for all. They went after the
driver, but it turns out he had exactly zip.

I think the cop knew the driver and his pax and let them off. It was a Sat.
afternoon and since neither got out of the vehicle (ever) booze was probably
involved.

blank.
