Well, in most of these cases, the "deep link" refers to an article
which is normally surrounded by frames containing advertisements. In
some especially egregious examples of deep linking, people have not
only deep linked the article in question, removing its ads, but put up
their OWN frame containing their OWN advertisements on top. This is
bad for business.

This only really matters on sites that have ad content in frames,
which is a lame-brained design decision to begin with. Not that this
point can be made clear to a judge or a jury.
